TERMS AND CONDITIONS

Please read these Terms and Conditions carefully before using this Website or making a purchase. By continuing to use our Website or making a purchase, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions ("Terms").

1.1.2. "You", "Your" means the individual (the buyer) placing an Order via the Website.

1.1.3. "Website" means www.geberich.eu.

1.1.4. "Products" means the food supplements, cosmetics, and other goods offered for sale on the Website.

1.1.5. "Order" means your request, placed through the Website, for the purchase of Products.

1.1.6. "Contract" means the binding agreement between You and Us for the sale of Products, formed upon our acceptance of your Order.

1.1.7. "Party" / "Parties" means either You or Us individually, or both collectively.

2. PRODUCTS AND ORDERS

2.1. Product Information

We describe our Products as accurately as possible, including composition, usage, and recommended daily intake. Images are illustrative and may differ slightly from the actual product.

2.2. Non-Medical Nature

Our Products are food supplements and cosmetics. They are not medicines and are not intended to diagnose, treat, cure, or prevent any disease. They do not replace a balanced diet or medical advice. Consult a qualified healthcare professional before use if you are pregnant, nursing, taking medication, or have a medical condition.

2.3. Availability

All Products are subject to availability. If a Product becomes unavailable after your Order, we will notify you and offer a replacement or a full refund.

2.4. Placing an Order

By placing an Order, you confirm that:

• You are at least 18 years old
• All information you provide is accurate and complete
• You have read and accepted these Terms, our Privacy Policy, and our Shipping & Returns Policy

2.5. Order Confirmation

After placing an Order, you will receive an automatic acknowledgement email. This acknowledgement does not constitute acceptance of your Order. The Contract is formed when we send you a separate email confirming dispatch of your Order.

2.6. Right to Refuse an Order

We reserve the right to refuse or cancel any Order at our discretion, including in cases of:

• Suspected fraud
• Pricing or description errors on the Website
• Product unavailability
• Regulatory restrictions in the destination country

If we cancel an Order after payment, you will receive a full refund.

3. PRICES AND PAYMENT

3.1. Prices

All prices are stated in EUR (€) and include applicable VAT. Shipping costs are calculated at checkout and shown separately before you complete your purchase.

3.2. Payment Methods

Payment is processed securely via our payment providers. Accepted payment methods are displayed at checkout and may include credit/debit cards, iDEAL, PayPal, and other local payment methods depending on your country.

3.3. Payment Security

We do not store full payment card details. All card transactions are encrypted and processed by PCI-DSS compliant payment providers.

3.4. Pricing Errors

If a pricing error is identified before dispatch, we will notify you and offer you the choice to either confirm the Order at the corrected price or cancel it for a full refund.

4. SHIPPING AND DELIVERY

Shipping terms, delivery times, and costs are set out in our Shipping and Returns Policy, which forms an integral part of these Terms.

5. RIGHT OF WITHDRAWAL

You have the right to withdraw from the Contract within 14 days of receiving the Products, without giving any reason, in accordance with Directive 2011/83/EU. Full details, instructions, and the Model Withdrawal Form are set out in our Shipping and Returns Policy.

6. STATUTORY WARRANTY

You have statutory rights under EU consumer law regarding faulty goods and conformity with the Contract (Directive 1999/44/EC and Directive (EU) 2019/771). These rights apply in addition to any other commercial warranties we provide.

If a Product is defective at delivery, contact us at sales@geberich.com within 48 hours.

7. LIABILITY

7.1. Limitation

To the maximum extent permitted by applicable law, our total liability arising out of or in connection with a Contract is limited to the total amount you paid for the Products concerned.

7.2. Exclusions

We are not liable for:

• Any indirect, incidental, or consequential damages
• Loss of profit, revenue, or data
• Damages caused by your misuse of the Products, failure to follow usage instructions, or consumption contrary to medical advice

7.3. Mandatory Rights

Nothing in these Terms excludes or limits our liability for:

• Death or personal injury caused by our negligence
• Fraud or fraudulent misrepresentation
• Any liability that cannot be limited or excluded under applicable law

Your mandatory rights as a consumer under the laws of your country of residence are not affected.

8. INTELLECTUAL PROPERTY

All content on the Website (including text, images, logos, layout, design elements, and product photography) is the property of Geberich OÜ or its licensors and is protected by copyright and trademark law. You may not reproduce, distribute, or use any content for commercial purposes without our prior written consent.

9. PRIVACY AND PERSONAL DATA

When you use our Website or place an Order, we collect personal data (e.g., name, contact details, delivery address, payment information). Data is processed in accordance with the General Data Protection Regulation (GDPR).

12. APPLICABLE LAW AND JURISDICTION

Unless otherwise required by mandatory consumer protection regulations in your country of residence, these Terms and any Contract are governed by the laws of Estonia. Disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Estonia, without prejudice to any mandatory rights you may have as a consumer under the laws of your country of residence.

13. AMENDMENTS

We may update these Terms from time to time. The updated version will be posted on the Website with a new effective date. Orders placed before the update remain governed by the Terms in force at the time of the Order.
